It is an inescapable fact that no trial can proceed while the Accused is exposed to the legionellosis bacterium

Today Charles Taylor’s lawyers got the start date of their defense case postponed from June 29 to July 13. Their reason? Legionella bacteria.

A few days ago this common and usually harmless bacteria was found at the ICC detention center, where Taylor is being held. Water pipes were replaced and filters installed, yet Taylor’s lawyers say they have chosen not to visit their client this week for fear of being exposed to the bacteria. (The prosecution said the bacteria are transmitted through showers and air conditioning, neither of which is present in the visiting area.)

Taylor’s lawyers asked for a one month extension because Taylor has not been able to consult with his lawyers during this time. (They argued phone conversations were not sufficient.) “It is an inescapable fact that no trial can proceed while the Accused is exposed to the legionellosis bacterium,” their motion stated.

The judges granted a two week extension, on the assumption that tests for the bacteria will have been completed and returned negative. The judges deemed the lawyers’ decisions to not visit the detention center “reasonable”

Was this a real risk or buy for time? I would guess the latter.
